The Regulatory Process

The disciplinary process, as outlined by the General Pharmaceutical Council, is carried out according to the following procedure.

Investigation

An inspector will gather all evidence arising from complaints and carry out an inspection of premises where required. Evidence and information relating to their defence must be provided by the pharmacist or pharmacy technician.

An investigating committee will decide whether or not the case should be presented at a hearing if the evidence suggests further investigation. A suspension, delivered by interim order by the fitness to practice committee, may be administered to the pharmacist or pharmacy technician at any point of the investigation.

Hearing

The Investigating Committee will consider all evidence, including that presented by the pharmacist or pharmacy technician in their defence, and of any experts or witnesses wherever relevant.

Decision

If fitness to practice is proved to be diminished on the balance of probabilities, the following actionsmay be enforced:

  • A warning
  • A 12-month suspension
  • A 3 year period of conditions or restrictions
  • Indefinite dismissal, prohibiting them from working in this field
  • Recommendation of criminal prosecution

Appeal

The pharmacist or pharmacy technician can appeal against any decision or judgement to the High Court within 28 days of the decision.

Internal disciplinary proceedings

We also represent any pharmacist or pharmacy technician involved in cases where their employer or line manager has brought internal disciplinary proceedings against them.
