The Regulatory Process

The disciplinary process, as outlined by the General Optical Council, is carried out according to the following procedure.

Investigation

All evidence will be gathered by a caseworker provided by the investigation committee; this includes information provided by the optician for their defence. The optician may be suspended or be held to specific conditions or restrictions under an interim order for the duration of the investigation.

The case will progress to a full hearing before the practice committee if the examiner finds sufficient reason.

Hearing

All evidence will be considered by a panel from the fitness to practice committee. This includes all information, including that of the optician under prosecution, any experts of the field and witnesses wherever relevant.

Decision

Any the following actions may be enforced if the optician’s fitness to practice is proved to be diminished,on the balance of probabilities:

  • The issue of a warning that must be disclosed to all enquirers
  • A financial penalty
  • Specific conditions that must be adhered to for up to 3 years
  • A 1 year suspension
  • Indefinite dismissal, prohibiting them from working in this field

Appeal

The optician can appeal against any decision or judgement to the High Court within 28 days of the decision.

Internal disciplinary proceedings

We also represent any optician involved in cases where their employer or line manager has brought internal disciplinary proceedings against them.
