The Regulatory Process
The disciplinary process, as outlined by the General Dental Council, is carried out according to the following procedure.
A caseworker will carry out the initial investigation, and if the matter is determined liable for further proceedings, an investigating committee will be requested to conduct the examination.
The committee will gather all evidence relevant to the case, including information supplied by the dentist. A full hearing will be presented to the practice committee if the case is considered to hold significant reason.

The practice committee will be either:
- The professional conduct committee
- The professional performance committee
- The health committee
The dentist may be subject to special conditions outlined by an interim orders committee or suspended until the enquiry is completed.
The practice committee will have all evidence presented before them, including that of witnesses wherever relevant. The dentist will be given every opportunity to present evidence in their defence.
If the dentist’s fitness to practice is proved to be diminished on the balance of probabilities, the following action can be taken:
- A reprimanding
- Imposition of conditions on the dentist’s practice
- Suspension for a set period of time
- Indefinite dismissal, prohibiting the dentist from working in this field
The dentist can appeal against any decision or judgement to the High Court within 28 days of the decision.
Internal disciplinary proceedings
