The Regulatory Process

The disciplinary process, as outlined by the General Chiropractic Council, is carried out according to the following procedure.

Investigation

All relevant evidence, including that of the chiropractor under investigation, will be gathered by the General Chiropractic Council to decide whether or not to further proceedings.

If sufficient evidence exists to merit further investigation, the committee will refer the matter for a full hearing to either the Professional Conduct Committee or the Health Committee.

Hearing

Any hearing must be carried out within 9 months of the allegation. The General Chiropractic Council will appoint a solicitor to present the case to a panel of 3 members. The panel must contain a chiropractor. The accused chiropractor must be given every opportunity to provide information in their defence, including the presentation of witnesses or experts wherever necessary.

Decision

If fitness to practice is proved to be diminished on the balance of probabilities, any of the following actionscan be enforced:

  • A warning
  • A suspension
  • Conditions or restrictions to practice for a specific amount of time
  • Indefinite dismissal, prohibiting the chiropractor from working in this field

Appeal

The chiropractor can appeal against any decision or judgement to the High Court within 28 days of the decision.

Internal disciplinary proceedings

We also represent any chiropractor involved in cases where their employer or line manager has brought internal disciplinary proceedings against them.
